1. In General

Please review these Terms and Conditions ("Terms of Use" or "Terms"), which govern your use of esler.renewalbyandersenspecials.com, consultation booking portals, mobile pages, and any related online services or communications (collectively referred to as the “Site” or “Sites”).

This Site is operated by Esler Companies, Authorized Renewal by Andersen Partner ("Company", "we", "us", or "our"), in affiliation with Renewal by Andersen LLC ("Renewal"). Your use of any of the Sites constitutes your unconditional agreement to be bound by these Terms and our Privacy Policy and SMS Terms & Conditions without modification by you. Please review these Terms carefully. If you do not agree to the Terms, do not use the Site(s). These Terms inure to the benefit of Esler Companies, Renewal by Andersen LLC, and their respective parents, subsidiaries, and affiliates.

Age Requirements & Eligibility: All consultation requests, estimate submissions, customer agreements, and SMS/RCS messaging enrollments are intended solely for adult homeowners and consumers aged 18 years of age or older. By submitting an inquiry, booking a consultation, or enrolling in our messaging programs, you certify that you are at least 18 years of age.

General informational browsing of the Site by minors aged 13 through 17 is permitted solely under the supervision of a parent or legal guardian who agrees to be bound by these Terms on their behalf. Individuals under the age of 13 are strictly prohibited from using the Site or submitting personal information. If you are a parent or legal guardian agreeing to these Terms on behalf of a minor between the ages of 13 and 17, you agree to be fully responsible for such minor’s use of the Site, including all financial charges and legal liability that such minor may incur.

If we determine that an individual under the age of 13 has provided personal information on the Site, we will delete that information as soon as practical. If you become aware that such information has been provided by a child under the age of 13, please contact us immediately at [email protected] or [email protected] so that we can delete the information.

Pursuant to 47 U.S.C. §230(d), as amended, we hereby notify you that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to material that is harmful to minors. All material provided on the Site is protected under United States copyright laws and international copyright treaties and is owned or licensed by Renewal, Esler Companies, or software and content suppliers. Except as expressly provided herein, none of the material provided on the Site may be copied, distributed, republished, reproduced, downloaded, displayed, or transmitted in any form without prior written permission.

3. Trademarks

Any trademarks, trade names, logos, service marks, brand identities, titles, graphics, and designs displayed on the Site—including "Renewal by Andersen", the Renewal triangle logo, "Fibrex", and "SmartSun"—are the property of Renewal by Andersen LLC or its licensors. Use of the Site in no way grants any license or right to use any Trademark displayed on the Site without prior written authorization.

4. Licensing and Permissions

Esler Companies is an authorized independent partner and licensee of Renewal by Andersen. Any unauthorized use of brand names, trademarks, service marks, copyrights, or other intellectual property is strictly prohibited.

You are permitted to print one copy of material purposely made available for downloading from the Site solely for your personal, non-commercial use, provided you: do not modify the materials, retain all copyright and proprietary notices, and do not make additional representations or warranties relating to such materials. This permission terminates automatically if you breach any of these Terms.

You may not: (a) download or print any materials on the Site for any commercial purpose; (b) use Renewal's or Esler Companies' trademarks in a manner likely to cause customer confusion; or (c) use intellectual property in any manner that disparages or discredits the brand.

5. Information Submitted

Any communication or material submitted to the Site—including inquiries via electronic mail, text messages, consultation booking forms, or customer feedback ("Site Submission")—is considered non-confidential and non-proprietary (subject to our Privacy Policy). You grant Esler Companies and Renewal a perpetual, royalty-free, worldwide license to use, reproduce, modify, and display Site Submissions for business operations, marketing, and fulfillment without restriction or compensation.

You are responsible for all of your Site Submissions. You may not submit material misrepresenting yourself as someone else or using a false email address or telephone number. You may not submit any content that violates third-party rights, is libelous, fraudulent, harassing, or otherwise unlawful.

6. Product Consultations & Orders

While we use our best efforts to fulfill all requests, Esler Companies cannot guarantee the immediate availability of every specific product style or color displayed on the Site. Product specifications, visual previews, and pricing estimates are provided for informational and consultation purposes. Official project specifications and pricing are confirmed during the in-home design consultation and executed customer agreement.

Prices quoted on the Site (if any) are in U.S. dollars and are valid solely for the designated service areas. We reserve the right to correct any clerical errors, inaccuracies, or omissions at any time.

7. User Generated Content (UGC)

From time to time, we or Renewal by Andersen may request permission to feature project photos, reviews, or social media posts you share. If you are contacted with a request to use your content, your consent grants Esler Companies and Renewal permission to display such imagery across digital and print marketing materials.

8. Digital Millennium Copyright Act ("DMCA") Notice

If you believe any materials on the Site infringe an intellectual property right, please submit written notice containing:

• A physical or electronic signature of the authorized copyright holder;
• Identification of the copyrighted work claimed to have been infringed;
• Specific URL or location on the Site of the infringing material;
• Your full contact details (name, physical address, telephone number, and email);
• A good-faith statement that the disputed use is unauthorized;
• A statement under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the owner.

You agree that you will not do any of the following:

• Restrict or inhibit any visitor from using the Site, including by means of hacking or defacing any portion of the Site;

• Harvest or scrape data about Site visitors without prior written consent;
• Frame or mirror any part of the Site without written authorization;
• Use automated bots, spiders, or scrapers to index or harvest the Site’s content.

13. Governing Law & Jurisdiction

These Terms and any dispute arising from your use of the Site shall be governed by the laws of the State of Rhode Island for local operating matters, and the substantive laws of the State of Minnesota regarding Renewal by Andersen intellectual property and licensing, without regard to conflict of law principles. You agree to submit to the personal jurisdiction and venue of the state and federal courts located in the State of Rhode Island.

Esler Companies reserves the right to amend these Terms of Use at any time by updating this posting with a revised "Effective Date." Your continued use of the Site following any changes constitutes acceptance of the modified Terms.
